Visa Prepaid Gift Card Agreement
This Visa Prepaid Gift Card Agreement (Agreement) contains the terms and conditions governing our issuance and your use of the Visa Prepaid Gift Card (Card). Please read this Agreement carefully and keep it for your records. In this Agreement, "you," "your," and “cardholder” mean: (a) the person to whom we issue the Card; (b) the person receiving the Card; and (c) the person using the Card. The terms "we," "us," "our," and "Bank" mean El Dorado Savings Bank, and its successors, agents, and assigns.
By using the Card the cardholder agrees to be bound by the terms and conditions of this Agreement. This Agreement, the Card and all Card transactions are subject to the laws of the state of California.
Your Card is ready to be used; the full value associated with the Card is immediately available to you and the Card does not need to be activated. Sign your Card immediately. Treat your Card like cash.
General
Your Card is a pre-paid access device and not a credit card. Your Card does not have a line of credit. There is no separate deposit account established in your name at the Bank for your Card. The Card is not reloadable and cannot be reused. The value of your Card is held in an aggregate account and there is no FDIC insurance to your benefit. You may not make any deposit or any other transaction except as described in this Agreement.
You acknowledge and agree that the amount available on the Card is limited to the prepaid U.S. Dollar value associated with your Card at the time of purchase. This amount is prepaid by the Card’s purchaser, and the amount available will decrease each time you use the Card to make a purchase or when you incur a fee or charge. The amount of funds shown on our records will determine the balance on the Card unless you can show that our information is wrong.
Our prepaid gift cards can only be purchased by Bank customers. The minimum value upon issuance is $25.00 and the maximum value is $250.00. Customers are allowed to purchase a maximum aggregate value in Cards of $1,500.00 within any 24-hour period or $2,500.00 within any 30-day period. We may, to the extent permitted by law, refuse to issue the Card to anyone for any reason.
Using Your Card
Your Card may be used to make purchases at merchants which have agreed to accept Visa debit cards. Your Card cannot be used for PIN transactions, to obtain cash at ATM machines or bank branches, to make pre-authorized regular payments, or for Internet gambling transactions. When using your Card at gas stations with "pay at the pump" capabilities, the Card cannot be authorized directly at the pump. You will need to present the Card to the attendant for payment.
You must have the amount available on the Card to pay for all transactions. If your purchase amount is greater than the amount available on your Card, the difference can be paid for with cash, check, credit card, or debit card, subject to the policy of the merchant. If a merchant attempts an authorization on your Card for an amount greater than the current balance the transaction may not be approved by the Bank. The Bank is not responsible for the failure of any merchant to complete a transaction with your Card. Your Card expires on the date shown on the front of the Card, except where prohibited by law, or when the entire value has been exhausted, whichever comes first.
Balance Inquires and Customer Services
You can review transactions and determine the balance of funds available on your Card by calling our Gift Card Care Center at 1-866-279-7980. A 25¢ fee may be assessed against your card balance for telephone inquires. (Currently, this fee is waived for the first three telephone inquires.)
Limitation on Frequency of Transfers
You may use your Card an unlimited number of times per day for purchases. You agree not to make transactions that exceed the amount of funds stored on your Card. We may limit the number of authorizations in a day or deny an authorization if we suspect fraudulent activity or for other security reasons.
Documentation of Card Transactions
You should receive a receipt each time you make a purchase.
Card Conversion
Cardholder can convert the Card to cash or a check with us or deposit the balance into an El Dorado Savings Bank account. A $15.00 fee will be deducted from your remaining balance at the time of conversion.
Disputes with Merchants
If you use your Card at a merchant, and a dispute with the merchant arises, you agree to make a good faith effort to settle the dispute with the merchant. Any unresolved dispute may be sent to us in writing for assistance in settlement. (See “Error Resolution” section of this Agreement for more details.) You cannot stop payment to merchants for transactions made through the use of your Card.
Visa Debit Card - Foreign Currency Transactions
If you make a transaction in currency other than U.S. dollars, Visa will convert the transaction into a U.S. dollar amount. The conversion rate will be determined using Visa’s currency conversion procedures then in effect. The conversion rate may be different from the rate in effect on the date of your transaction and the date it is posted to your Card. Currently, Visa uses a currency conversion rate of either: (1) a range of rates available in wholesale currency markets, or (2) a government mandated rate. In addition, Visa then charges a one percent (1%) International Service Assessment (ISA) fee. We will charge your Card the converted U.S. dollar amount determined by Visa as described above plus Visa’s ISA fee.
Legal Transactions
You will only use your Card for transactions that are legal. Display of a Visa logo by an online merchant does not mean that an Internet transaction is legal. We will not be liable if you engage in an illegal transaction.
Disclaimer of Liability
In providing the Card and related services to you, the Bank disclaims any duty or responsibility other than those expressly set forth in this Agreement.
Termination of Card
The Card shall remain the property of the Bank. You agree to return your Card upon our request. The Bank may revoke or cancel your Card without prior notice and terminate this Agreement. If you request, we will send you any balance remaining on the Card. You may terminate this Agreement at any time by returning your Card to us. Termination, whether by you or the Bank, shall not affect prior transactions or obligations relating to your Card existing at the time of termination.
Amendment of Terms and Conditions
These Terms and Conditions may be amended from time to time by us.
Severability/No Waiver
If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. The Bank's failure to enforce the strict performance of any provision of this Agreement will not constitute a waiver the Bank's right to subsequently enforce such provision or any other provisions of this Agreement.
Governing Law
This Agreement, the Card and all Card transactions are subject to the laws of the state of California.

The following fees and charges are imposed by the Bank on your use of the Card.

Bank Liability to You for Failure to Complete Transactions
If we do not complete a transaction on your Card on time or in the correct amount, we will be liable for your losses and damages. However, there are some exceptions. We will NOT be liable, for instance, if:
- Through no fault of the Bank, you do not have enough money on your Card to complete the transaction;
- The transaction would exceed the value on your Card;
- Circumstances beyond Bank's control (such as acts of God, fire, or flood) prevent the transaction, despite reasonable precautions that Bank has taken;
- Bank is prohibited by law from completing the transaction;
There may be other exceptions stated in Bank's Agreement with you.
Disclosure of Card Information to Third Parties
We will disclose information to third parties about Card transfers you make:
- Where it is necessary for completing a transaction;
- In order to verify the existence and condition of your Card to a third party, such as a merchant;
- In order to comply with a governmental agency or court order; or
- If you give us your written permission.
Lost/Stolen Cards
If you believe your Card has been lost or stolen immediately call toll free at 1-866-279-7980. Your Card can be immediately deactivated in an attempt to protect your remaining balance. Customer Care representatives are available, 24 hours per day, 7 days per week. You must be able to provide your Card number to file a lost or stolen card. A replacement Card in the amount of the remaining balance can be issued. (See “Schedule of Fees and Charges” section of this Agreement for cost to reissue Card.)

You must notify us no later than 60 days after the date of the transaction in question.
You must:
- Tell us your name and Card number;
- Provide us with information that confirms that you are the legitimate owner of the Card;
- Describe the error or transaction you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information;
- Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.
Our Card Services Department is available Monday through Friday from 8:30AM until 5:00 PM. (See “Lost/Stolen” section under this Agreement if you need to immediately deactivate a card.)
